1) The following terms and conditions govern the sale of products by My Digital Squad. By submitting your order to us, you are indicating acceptance to be bound by these terms and conditions. These terms and conditions may be changed without prior notice at the sole discretion of My Digital Squad. 2) The products and pricing listed on our website are not to be considered offers to sell, but rather advertisements to receive offers of purchase. All orders are subject to review and acceptance by My Digital Squad. All prices are subject to change so your order may not be accepted or you may be advised of issues of pricing or availability in regards to your order.

Order Acceptance Policy:
3) Receipt of order confirmation sent to you does not signify our acceptance of the order nor does it constitute confirmation of an offer to sell. My Digital Squad reserves the right to accept or decline your order for any reason at any time after receiving your order. Only based on shipping confirmation will our acceptance of your order be confirmed. All orders must be pre-approved with an acceptable method of payment before shipment occurs. We may need additional information for verification purposes before we accept any order.

Prices:
Prices: 4) All prices shown on mydigitalsquad.com are in USD and CAD and do not include the applicable taxes unless otherwise noted. The prices do not include shipping and handling nor any other services such as insurance. Please note that price are displayed in the 2 above currency automatically detected by an auto-geolocation when you log into the website. If you are out 2 geo-zone or hiding your IP through any means USD will be the default. Example USD $0.00 and CAD 0.00$.Price charged for orders will be the price at the time of the order.

Typographical Errors:
5) My Digital Squad reserves the right in the event of any item listed at an incorrect price or with incorrect information due to a typographical error or an error on information received from our suppliers to decline and/or cancel any orders for the incorrectly listed item. We may cancel at our discretion orders which may or may not have been confirmed including orders which may have been paid for or charged to your credit card. In the event a charge has been made to your credit card,My Digital Squad will immediately issue a credit to your card to offset the purchase.

Shipping & Handling and Taxes
6) You, the buyer, are responsible for all applicable charges including but not limited to: shipping, handling, delivery, taxes and applicable tariffs associated with the purchase. This may include Tax such as Fedx , UPD , DHL etc. as this may occur in some countries. We will try to advise you if you choose such shipping method as standard shipping can be use and no tax may occur.

Risks Associated with shipping:
7) When My Digital Squad ships the product, our liability for damage or breakage on the shipment will be limited to the coverage provided by the carrier's terms and conditions. You may wish to purchase additional insurance coverage for the full value of the product when you order. The appropriate request should be made when you submit your order request. My Digital Squad does not give any delivery guarantee such as specified time or date. ** All shipping dates are estimated from information provided by the carrier and internal processing time**.

Limitation of Liability:

Order Acceptance Policy:
13) If any provision of these Terms and Conditions is held to be illegal, invalid or un-enforceable, in whole or in part, the legality, validity and enforceability of the remainder shall not be affected nor impaired. The Terms and Conditions stated herein are declared to be Severable.

Assignment:
14) This agreement with My Digital Squad cannot be assigned without My Digital Squad' written authorization. My Digital Squad is the intended beneficiary of this agreement. If there is any inconsistency between this agreement and other information or agreements included or relating to products purchased from My Digital Squad, this agreement will take precedence.

Linking and Framing of this website:
15) Links to this website without the expressed permission of My Digital Squad are strictly prohibited. We reserve the right to cancel or revoke any permission given to link to our site at any time for any reason, without any notice without liability to you or any other person. Framing of this website or any of its content in any form or by any method is strictly prohibited.

In order to provide a quick and accurate response to your web design project, My Digital Squad. asks only for the information necessary to work with you or your company. All of the information is strictly for the use of My Digital Squad and it will not be shared with any other third party. My Digital Squad uses Secure Socket Layer (SSL) technology to protect your privacy when you place an on-line order.

The information we gather and how we use it: When you move forward with a web design project with us, we will need to know your name, your company's name, your email address, and your mailing address. We also ask for some information about your company in order to have the necessary creative direction for your company's design needs.

Refund Policy


We guarantee your full satisfaction or your money back. An administration fee of 3.5% of your original purchase price will be deducted from the amount refunded. The refund policy will not take effect in any of the following events:

How the money will be transferred: If you have paid using your credit card - the money will be transferred back to your credit card account. It may take up to 6 business days before the money will appear on your account. If you have paid using a cheque or a money order your refund will be sent to you by cheque.

If you have given the final approval of your web design. If work was commenced on one of your samples or if we have started work on the conversion. If the party for whom the website is being designed closes, changes its name, or changes its activity. If the project was cancelled for reason(s) unrelated to the project undertaken with My Digital Squad.

If you do not communicate with My Digital Squad for more than 3 weeks following the signing of the design contract.

Design Warranty


My Digital Squad warrants that its designs are of its own creation from themes and are not copied from existing designs or trademarks; but does not warrant that a design that is the same as or is similar to the one designed by it, but of which it was not aware at the time of its creation, does not exist.

In the event that payment for any web design service is not made in accordance with the payment policies of My Digital Squad, then all of the client's rights in and to the web design created for it, including any trademark property, will immediately revert back to My Digital Squad Adaptive Mobile Conversion:

Description:
My Digital Squad takes responsibility in coding your original web site pages so that they are displayed in a compact (usually vertical) layout, which is also adjustable to the size of the mobile browser window. It also involves the adaptation of a navigation bar in to a standard pull out menu.

Since there are hundreds of devices and operating systems (different versions) it is impossible to guarantee a 100% compatibility on all devices, or so that the content is displayed the same on all of the devices available on the market.

We guarantee to test functionality and display characteristics on a couple of major latest devices.

Content Writing:


Description: My Digital Squad takes a task of creating written content for the web site based on a comprehensive questionnaire provided by My Digital Squad to the customer. You can purchase a package with a limited amount of words, which does not guarantee the full amount of words. It rather limits the amount that can be provided to the customer. The total amount of words is limited to the package purchased as well as the information provided by the customer.

Billing and Payment Terms and Conditions:


DEFINITIONS “Goods” means any goods and/or services provided by the Company as ordered by the Client “ Company” means Sample Answers Ltd. incorporating Prime Prospects. “ Client” means the person, firm or company placing an order with the Company.

1) FORMATION OF CONTRACT All Goods sold by the Company are sold subject to the Company’s standard terms and conditions (as detailed in the policy section) which form part of the Client’s contract with the Company. Terms and conditions on the Client’s order form or other similar document shall not be binding on the Company.

2) ORDERS Orders will be deemed to have been placed when an email confirmation has been received from a responsible executive of the client or company.

3) RIGHT TO SUB CONTRACT Unless otherwise agreed the client or Company shall be entitled to sub-contract all or any part of the work.

4) RISK OF LOSS The risk of loss or damage to the Goods shall pass to the Client upon delivery of the Goods.

5) PAYMENTS

5.1 New clients or other clients out of terms may be expected to pay or make a deposit in advance for their services.

5.2 All other invoices issued by the Company shall be paid by the Client within thirty (30) days of the date of invoice unless otherwise agreed in writing by the Company. In the event of late payment, the Company may charge interest on the amount outstanding before and after judgement at the rate of five (5) percent above the Base Rate from the due date until the date of payment.

5.3 If any amount of an invoice is disputed then the Client shall inform the Company of the grounds for such dispute within seven days of delivery of the goods and shall pay to the Company the value of the invoice less the disputed amount in accordance with these payment terms. Once settlement of the dispute has been agreed, any sum then outstanding shall also be payable in accordance with these payment terms.

5.4 The Company reserves the right to increase a quoted fee in the event that the client requests a variation to the work agreed.

6) CANCELLATION

In view of the nature of the service, any order – once confirmed by the Company – is not cancellable. Cancellation of the Order by the Client will only be accepted on condition that any costs, charges and expenses already incurred, including any charges that will be levied by a sub-contractor on account of their expenses, work or cancellation conditions will be reimbursed to the Company forthwith.

7) DELIVERY

7.1 The majority of services as supplied by the company are despatched electronically by email and shall be deemed as having been delivered when the email has been opened by the client. 7.2 The Company reserves the right to substitute conventional delivery methods without notice or penalty should electronic despatch prove inconvenient; in which case delivery by the Company will be deemed to have taken place when the materials are handed to the custody of the Client at his premises or to a deputed messenger or courier when posted. The Company will be entitled to charge the Client for any expenses of delivery other than normal postage charges.

8) FORCE MAJEURE

The Company will not be liable to the Client for any loss or damage suffered by the Client as a direct result of the Company, its sub-contractors or the list-owner from whom the sample or other service or material is derived being unable to perform the Contract in the way agreed by reason of cause beyond its control including Act of God, accident, war, riot, lockout, strike, flood, fire, power failure, breakdown of plant or machinery, delay in transit, postal delay, or any other unexpected or exceptional cause or circumstance.

9) Sample design request
In case clients or company require a sample or similar demo design website before the project a deposit will be required for this task.

10) All coding errors that occur or plugins after delivery of project may be due to unrelated to errors on project but browser update etc. We will review such error. Note that we are not responsible for such browser update lead to error that require website update. In such a case please contact us, we will review the issue and update the website code etc to fix the issue (s) fees will incur.

This allows us to process and complete your order and to notify you of your order status. We also ask some information about your company in order to have a creative direction for your company's logo design or web design needs. All the rights to the Logo artwork and logo design we create at the request of a client belong to such client.

Refund Policy

If the party for which the logo was being designed closes, changes its name, or changes its field of business.

If the project was canceled for reasons unrelated to the logo designed by My Digital Squad

If you have not communicated with My Digital Squad for more than 6 months following the submission of the logo design.

If other design companies were simultaneously hired to work on the same logo design project.

Legal Rights Agreement



All the rights of the logo design and logo artwork My Digital Squad has created and designed for specific client belong to the client for which it was designed. LogoBee, Inc. does not hold any rights to the logo design created for a client.

My Digital Squad does not file a trademark application with respect to the logos designed for its client. The client is free to register as a trademark the logo design created for it by My Digital Squad.

In the event that payment for any logo design is not made in accordance with the payment policies of My Digital Squad then all of client's rights in and to the logo design created for it, including any trademark property, will immediately revert back to My Digital Squad.

My Digital Squad warrants that its designs are of its own creation and are not copied from or inspired by existing designs or trademarks but does not warrant that a design the same as or similar to that designed by it, but of which it was not aware at the time of its creation, does not exist.

If for some coincidental reason a logo designed or web designed by My Digital Squad looks identical to another party’s logo, My Digital Squad will provide a free redraw session with a new set of logos. CMYK, Pantone colors, printing responsibility:

For the purpose of versatility we will supply your logo kit with files in different color modes such as RGB, JPEG,PNG,SVG When you are approving your logo on the computer monitor, you are only approving RGB colors. Computer screens can only reproduce RGB colors and only simulates other color modes. We do our best to match RGB colors on our computer screen to CMYK or Pantone colors, but it is physically impossible to find an exact match. When we convert your files in to different color modes (CMYK, Pantone) we hold no responsibility for matching exactly your approved RGB colors. It is the clients’ responsibility to double-check and make sure the printer gets the right color. Furthermore when printing in CMYK process the printed colors may vary. This is due to a non standardized color pallet used by this process printers, and calibration of the machine. Therefore My Digital Squad is removing all the responsibilities for the outcome of the printing quality and colors.

My Digital Squad holds no responsibility for retraced images:

Any idea provided by the client: sketch, copy, fax, file… that My Digital Squad is asked to use in the logo design process removes its responsibility from any copyright violation or warranties. In such circumstances My Digital Squad cannot guarantee the originality of its work and therefore will not be held liable for any damages or violations. A waiver form is required to sign prior to My Digital Squad using any images provided by the client.

Timelines:



The general delivery time line for the first logo design concepts is 5 business days.

Every following change will be delivered in 1-2 business days. More complex changes or redraws may be delivered up to 5 business days (depending on the complexity of work).

All redraw deadlines are determined by the receipt of all necessary information pertaining to the re-designing of the logo.

Font information:



My Digital Squad will provide all font names used in the logo design process.

My Digital Squad does not provide the actual font files.

Stationery design and final approvals on the logo:



Our logo design packages are split in to several different steps. Please take note that once you give a final approval on your logo you may only request another logo change at an additional charge. If you have ordered stationery, we will use your approved logo to design your business cards and letterhead. However in both cases, changes to approved logos are charged a minimum of $25.

Upon the final approval of a logo and/or stationery design,My Digital Squad will require up to 1-2 business days to put together all of the files. For digital delivery packages the shipment will be processed after we receive your address confirmation. Camera ready artwork is available for shipping within North-America; however International clients will be subject to additional shipping charges.

Loss of data:



My Digital Squad will take all appropriate precautions to safeguard its servers and data contained within, however My Digital Squad will not be held responsible for any loss of client data stored or intended to be stored on the servers and on back-up devices. The client will not be entitled to any form of compensation from My Digital Squadin the event of loss of data, therefore it is recommended that the client also takes steps to back up his/her logo materials.

Prices and services:



My Digital Squad may make changes to the website and information provided, i.e. publications, prices, technical specifications, promotions and product offerings at any time and without notice.

Sunglasses purchased online cannot be returned in-store. (Please send them back to us!)

You will receive your refund through your original form of payment. If you return your items in store, we can process an exchange or issue you a merchandise credit.

Well, this is awkward. If you received a gift that you’d like to exchange please contact Customer Care for help. You can exchange the item within 14 days of the shipping date, or exchange it for a merchandise credit within 30 days of the shipping date.

How to Request a Return



Sign into your account and under My Order History, select the order containing the items you would like to exchange/ return. Just click 'Order Tracking' at the bottom of the page and fill in your information. Click on the 'Return Items' button.

On the Returns page, select the items you would like to return and the reason why you want to send them back. If your item has a defect, please include details so we can work to fix it!

Your Return Package: 4 Steps To Prep

If you saved the clear Aritzia bag, put the item(s) you want to return securely back in the bag, along with the original invoice or gift receipt. Place the bag into the brown box we sent your order in and securely seal it. Stick the Return Label provided on top of the original shipping label (make sure the previous label barcode is completely covered).

Book a pick-up with the shipping carrier found on your Prepaid Return Label or drop off your package at the shipping carrier's location.

Note: If you are returning multiple items, please try to include all items in one box and use one Prepaid Return Label (even if some of them arrived in seperate shipments or boxes).

When your refund is complete, we'll e-mail you right away and let you know.

P.O. Box Deliveries Only: If your purchase was shipped to a P.O. Box in Canada, please drop off your return at Canada Post. P.S. A return postage fee of $8.00 (plus applicable taxes) will be deducted from your refund, along with any original shipping charges.

Online Return Refund & Processing



Your refund will be credited to the original method of payment via My MyDigitalSquad.com with shipping and returns fees deducted.

All returned items that were purchased using a Gift Card will be refunded to merchandise credit on a Merchandise Card.
